Trends in Lawsuits to Watch Out for and What Contributes to Them

The hospitality industry is not immune to being served with lawsuits. Consequently, there are trends to these lawsuits that can be studied. These are a couple of the trends in lawsuits in the industry and some things a hospitality expert looks out for.

Wage and Hour Prosecutions

About 30 hotels each day are slapped with an FLSA prosecution by the wage and hour division of the US Department of Labor each day. This doesn’t take into account the private filings – estimated to be in the thousands – made by attorneys every year. But why are they constantly being sued with regards to wage and hour? A number of those in the hospitality industry engage in shady practices or are not complying with industry standards.

Disability Lawsuits

A law passed in 1990 allowed the creation of spaces more accessible for the disabled. As a result, hotels that are not accessible for the disabled can end up being sued. Thirty-five hotels in an Arizona area were sued by a disabled woman for not having a proper pool lift.

In conclusion, those who are facing litigation against a bar, hotel or nightclub can benefit from the services of a hospitality expert. An expert can come in and take a look at the issue. The expert can determine if industry standards were followed. Sometimes, that’s all you need in order to convince a jury.
